AC> We taped meeting after meeting with the CASA rep and then finally had
AC> a "showdown" meeting where we asked her, I believe, 52 questions, each
AC> of which she denied. That meeting was also taped so we have an
AC> excellent action against her and her organization.
I love it! Don't tell me, you didn't inform her that she was being taped,
did you? It's amazing what these people will say when they don't know
their statements are being recorded. Somehow or other, my "friend" just
happened to tape the social worker admitting that her child would be safe
in her home , yet the same social worker is saying otherwise in his
written recommendation to the court. Now isn't that interesting??? :)
AC> Social services started by threatening to take my client's daughters
AC> away from their mother if she moved from a particualr county until
AC> after my client's trial was over. She moved and, sure enough, they
AC> took the girls. I won't even go into the lies and abuse by social
AC> services, ..., they stepped on every right an individual could have.
No need to go into detail, I can imagine. Has mom got the girls back yet?
AC> As to my client's attorney, he was retained 4 months in advance of
AC> trial, yet prepared his entire defense the night prior to trial ...
What? This is the kind of attorney that gives lawyers a bad name. I feel
really sorry for your client and his family.
AC> At trial, the DA offered to dismiss all charges against my client if
AC> he would plead guilty to an assault on a niece. He said he had not
AC> done anything wrong and would not. WHEW! That girl testified to
AC> things she had never mentioned previously and between her testimony and
AC> the psychologist, my client got 32 years.
That is Absolutely Outrageous! One of my "friends" sons pleaded no contest
to two misdemeanors rather than take a chance of being falsely convicted and
spending 8 years behind bars. My "friend" and her husband aren't happy with
this but fell that it may have been in his best interest. The charges will
be dismissed and erased from his record in two more months though when his
informal probation is over. Charges against the other boy were dismissed.
I hate plea bargains. I understand the purpose of them but too many innocent
people end up admitting to things they didn't do to protect themselves from
the consequences if they are falsely convicted. Basically, it's amounts to
innocent people being wrongly convicted and given extremely long sentences,
while the guilty cop a plea and walk away. This is insanity!
AC> We are filing complaints ... against the DA and my client's attorney.
AC> .. a civil action for mal-practice against his attorney. .. complaints
AC> with the state and American Psychological Associations for the actions
AC> of the psychologist and a civil action for mal-practice. We are filing
AC> a complaint on a national level for the actions of the local social
AC> service workers. If we are able to file a civil action, we will ...
AC> We are filing complaints against the CASA representative and will also
AC> file a civil action in that matter without question.
Oh, I do hope it is successful. These people really need to start being
held accountable for their actions. If there is anything I can do to help,
please let me know. I'd love to see the cases where the DA's immunity
was broken, especially the suit that won $4,000,000! About the DA running
for Appeals Judge, it seems that about the only ones who DO care about the
children are their families, and of course, the legal system won't believe
them. This is such an injustice to our children, to families, and to the
American dream. Let us know what happens with the FBI deal. I've heard of
people going to the FBI with things like this, but I don't how successful
it is. This will be very interesting!
AC> Well, sorry to ramble on and on. Just got carried away .
How can you not get carried away when the injustice is so devasting?
AC> I have been reading a lot of posts here from someone in Arkansas and in
AC> Williamsburg, Virginia. They both seem to be extremely intelligent and
AC> obviously care a great deal about what they are doing so keep reading
AC> and something may jump up that offers a solution to your problem.
I've been reading everything that comes through here and saving copies of
it. There is an awful lot of useful information and I hope to be able to
apply some of it where it will be the most beneficial. I think we have
a great group of people here and on VOCAL and CHILD ABUSE ISSUES as well.
AC> My very best to you and your husband and my prayers are with you.
AC> I have read your posts here for quite a while and wish you all every
AC> blessing possible.
Thank you so much for your support. It is very welcome. About the Swan
case, I too have high hopes for the Swan case and am very interested in
it's outcome. Your client and his family are in our prayers as well. If
you get back out this way (San Francisco area) our door is always open
and you are welcome to stay here if you wish. (No, I don't tell everyone
that, but it seems to me that as long as the good guys are helping the good
guys, then things will have to get better.) Of course, you would have to
put up with us, a bunch of kids, a bunch of cats, and our dog, but
we would consider it a privilege to help in some way.
Sincerely,
Valery Frosty
