And "avoided" by avoiding _any_ standards that are high enough to risk
disproportionate failure rates, or by race-norming the tests.
South Carolina was sued by the NEA because blacks were less likely than
whites to score high enough on the National Teacher Examination to pass the
state's certification requirements, and that state lost. As a result, many
states have chosen to dodge the issue by simply race-norming the NTE.
