yep it appears they did correct that in the review update.

I just wonder how many times MS has to upload this silly software to check
on valid users. I've downloaded versions of it numerous times in the past
and the only thing it has done of late is make me highly irritable. It 
also appears to have accomplished that with quite a few on the
windowsupdate forum.  If Microsoft wishes to send the message to legitimate
users that they will continue to nag you to death on valid software so you
may as well stay away from their products they have succeeded with this
user. Pity - I actually liked some of their products
