Perez, Dunn, Putnam, and Lister v. Reno, et al.
Home School Legal Defense Association filed a federal complaint on behalf
of four home schooling fathers seeking declaratory judgement that the Gun
Free School Zones Act, codified as 18 U.S.C. 922(q), is unconstitutional
as applied to private home schools. In its initial response to the lawsuit,
the Department of Justice reported that it "does not interpret the Gun Free
School Zones Act of 1996 to apply ... to individuals who home school their
own children and otherwise lawfully maintain afirearm in their residence."
Having thereby obtained protection for home schooling parents in all the
private school states, the home schooling fathers agreed that the case need
not be pursued. The case was then voluntarily dismissed.
