It really isn't a "kick back". What it is a a profit sharing pool. If a
GP over refers, for anything, then the pool is depleted and they do not
get to share in the balance when the year is over.
That practice has become illegal in several states (NY included, and I
lobbied actively for it). There is a bill in Congress that would ban it
nationwide.
