The 11th Court of Appeals didn't instruct the Clinton administration to do what they did, although Clinton tried to imply that it did in his explanation. Cuba is still a Communist dictatorship, where the government owns everything - and attempts to own your mind as well. Castro has said that Elian will spend a minimum of three months in a psychiatric hospital when/if he returns. Elian's father won't have custody - the Cuban Gov't will. Up to 10 years ago, it didn't matter who you were... if you made it across the Florida straits - or even outside the 12 mile line - you were happily welcomed to America. The thought of forcibly returning someone to a Communist dictatorship, any Communist dictatorship, was absurd. And if Cuba is such a wonderful place that would have all of it's problems solved if only the dumb Americans would normalize relations... well, apparently the Canadians are on good terms with Cuba, and I believe the Swiss as well - how many other countries does Cuba have happy diplomatic relations with?
