Yeah it is OK when you specify a location and an extension.
No specified Drive/directory and no extension, and then the PATH is the
deciding factor on which it finds first.

Ramdrive is loaded in Config.sys
The SET statement is in the AUTOEXEC, and can be anywhere before you start
needing to use it

Mine is near the start, as I use the %RAM% designation as the drive to copy
the BAT files to.
