In a decision that probably surprised nobody, the 9th Circuit
yesterday ruled that a child's possession of a handgun or handgun
ammunition affects interstate commerce, so Congress can
constitutionally ban such possession.
For reasons that remain unclear even after reading the opinion, the
9th Circuit felt that minors possessing handguns affects interstate
commerce more than people having guns on school campuses, so the US
Supreme Court's decision in US v. Lopez, which struck down the
federal Gun-Free School Zone Act, did not control. Of course, the
real reason is clear--they're the 9th Circuit, probably the most
anti-gun, among the most liberal, and certainly the most-reversed
Circuit in the nation.
