Actually, I intended it as a retorical question.
 
I was assuming that both the Ham and the CBer were on American soil.
If _I_ did it, I would definately expect a NAL from the FCC.   :-<
 
I would tend to ignore such illegal activities as much as possible, but
if the situation became interable, I would probably start pounding out
CQ's a couple of hundred Hz from their carrier with every watt I could
pump out to the antenna... see if they can talk through DADITDADIT
DADADIDA  DADIT DIT... repeated a few dozen times.   ;-}
 
Would this be legal, considering that I would be within my licensed band
and mode and they are neither?
