Then the custody aspect should have been handled by the state rather than
the INS and Border Patrol.
I remind you, it was Clinton (through his puppets) that first attempted to
convince the 11th Circuit to authoraize the custody transfer, for which
the court declined to become involved. The WH at least had enough sense to
know they needed a warrant , and enough sense to know that they would not
likely get it unless they pulled the kind of scam they did around 7:30PM
the Friday before.
