DEPARTMENT OF EDUCATION REQUESTS IDEA REGULATORY COMMENTS
The Secretary of Education requests comments, including advice
recommendations from the public, for the development of
regulations implementing the new IDEA Amendments of 1997
(P.L. 105-17). The Department wants input on specific areas to
clarify a statutory provision, including the identification of a
particular section of IDEA or ofthe current IDEA regulations.
The Department will determine the need to regulate through
evaluating the comments they receive in relation to the following
principles:
(1) whether regulations are needed to promote quality and
equality in educational opportunity;
(2) whether a demonstrated problem requires the issuance of
regulations;
(3) whether regulations are needed to resolve ambiguity; and
(4) whether a uniform approach to a situation is appropriate.
This is an excellent opportunity to help craft the new regulation
that will govern how schools implement the new law.
Comments should be addressed to Thomas Irvin, Office of Special
Education and Rehabilitative Services, U.S. Department of
Education, Room 4607, 330 C Street, SW, Washington, DC 20202.
Identify who you are when sending in comments (e.g. parent of
child with disability, teacher, advocate etc). Keep in mind
principles 1-4 above when writing your comments.
Comments are due on or before July 28, 1997!
