In the U.S. it is OFTEN presumed to read the minds of individuals: Many Gay
men have been prosecuted with "intent" when meeting near public
restrooms -- even though no actual actions had been taken.

Merely predilection and position and the state's allegations of
"intent" were enough to prosecute.
