RW>So the best thing to say is; "I will answer any
>questions after my attorney is present. Until then I
>exercise my right to remain silent." or put another
>way; "Lawyer, lawyer, lawyer. I want my lawyer."
CH> There are lots of different scenarios which require
CH> different responses. In a matter as serious as the one you
CH> depict, it is obvious that it would be important to have a
CH> lawyer present. On the other hand, merely telling the
CH> officer at the scene "He was coming at me, I had to kill
CH> him...." sounds more exculpatory than inculpatory.
But it still sounds bad to a jury when you are sitting
in a court room with a crying mother and/or a 'poor
man' in a wheelchair suing you.
Not to mention the DA who thinks the way to make
political points is to taken on the states CCW law by
showing how the state is allowing 'killers' to go
around armed.
I will still suggest to people it they are ever
involved in any kind of shooting, even if they have to
shoot an intruder in their home, to refuse to say
anything until they have their lawyer standing right
next to them.
