Medical Marijuana
is anybody out there?
This is the story of my court case against the State of Colorado. During my
struggle I discovered that my state already had a law on the books, Colorado
Revised Statute (CRS) 25-5-901, which recognized the medical value of 
marijuana
in case like mine. It also allowed the University of Colorado Health Sciences
Center to obtain marijuana from law enforcement to supply pharmacies in the
state with medical grade marijuana. I could not believe it, everything I had
been saying for years was already on the law books.
Imagine the Alice in Wonderland state of affairs in Colorado since 1981. Tens 
of
thousands of Colorado citizens were being arrested for possessing and growing
marijuana under one state law, the Uniformed Controlled Substance Act which
defines marijuana as a schedule 1 drug that "has no medical value". Yet, 
here
was another state law on the books at the same time that stated that the
legislature "recognized the medical value of marijuana"!
However, when I started to inquire about the program, I discovered that there
was no program, indeed, that there had never been a program. Perhaps twenty
thousand dollars was spent on a tobacco research program instead, but there 
was
no accounting of anything. In fact, as I asked about this law I found that no
one seemed to know about it even when I showed it to them! I became confused
because I did not think that some laws are enforced while others are totally
ignored by state officials and law enforcement.
I tried to find a lawyer to explain the situation, but was unable. I tried to
get legal representation to sue the state to explain why they were ignoring 
this
law, again I was unable to get help. Lawyers were not interested in 
representing
me, although they all wished me well.
Ultimately, I decided to file the suit myself, even though I did not know 
where
to start. I started with my friends, a copy Black's Law Dictionary, and a 
opy
of the Statutes of the State of Colorado. I filed a complaint against the
Chancellor of the Health Sciences Center, Case No. 93CV6093 District Court, 
City
and County of Denver, Colorado.
There were two issues as I saw it. 1) What happens when two laws directly
contradict each other? and 2) What happens when a law has been clearly 
gnored
by a state official, i.e., the Chancellor of the Health Sciences Center?
What were my rights as a medical marijuana user? Was I a criminal? Or was I a
patient? I know when the police arrest people for marijuana possession they 
o
not inquire if you are a patient.
Eventually I was worn down by procedures, expenses, and threats of having to 
pay
the state's mounting legal fees. The next year the state legislature repealed
the medical marijuana law in Colorado to make sure that no medical marijuana
patient would escape arrest in Colorado. My faith in government is pretty
