Depending on which version of maxcomm.dll you are using,  you might try:

 SET COMM_OPEN_SHARE=(any value)

This is an undocumented thing I put in/take out once and a while...it is
not the _right_ way to do things,  but there are too many _wrong_ programs
out there.
