It matters not who wrote them, whether it be Atari employees, Atari

Only if Llamasoft and/or Rebellion retained any contractual ownership
rights to the code, which I highly doubt. I don't know about AvP, but I
believe Tempest is 100% owned by Atari, and that the coding was fully
purchased by Atari. Unless Jeff Minter tricked Atari into signing a
contract giving him some residuals, I think Atari can do as it pleases.
Knowing the Tramiels, I doubt if they would have signed away anything to
a 3rd party. Tempest 2000 should be the pack in! Besides, it makes
more sense to have a piece of the Atari heritige as the "demo" game for
the Jaguar. :-)
