Can one really sue social services for civil rights violations?  If so,
I'll have one heck one of a case.  My husband and I are in the process of
putting together a civil suit for violations of our first amendment and
the fourteenth amendment rights.  There are other violations as well, but
we are concentrating on what will be the easiest to prove and we have
already found precedence in Supreme Court rulings that back up our 
complaints.  I can't say more than that at the moment, due to a prior
restraint violation of my first amendment right to free speech (i.e.
g_g order).  The problem is, we know WHAT we can sue for (the complaints)
but WHO to sue is the $90,000,000 question.  We were thinking of "the
county, social services, the Judge(s), the social worker" and whoever
else we can put on there.  Any info on the subject would be greatly
appreciated, especially since we are doing this on our own.

  Val's getting a little too close to saying too much, so it's my turn
  to talk.  I don't have a gag order, so it's not a problem.  Val was 
  gagged for going to the Board of Supervisors and giving a speech about
  the retaliation that CPS uses to keep parents in line, and how the 
  county was corrupt (judicial system, police department, and CPS working
  together to cover their butts).  CPS retaliated by having a Judge slap
  a gag order on her "for the protection of my daughter's privacy" because
  she is in a foster home (for the past 7 months).  CPS took my daughter
  illegally, not following state mandated guidelines, and they have been 
  trying to cover their butts ever since - even getting the police to 
  file a falsified police report to the D.A. the day after we went to 
  court (with a Public Defender) and told CPS that we were going to fight
  them all the way because they were wrong.  When we make things a little
  too hot for them CPS takes away visits and phone calls with my daughter.
  They don't "officially" do it, something just conveniently comes up.
  Oh yeah, CPS says that my wife's comments to the press and the Board
  of Supervisors had "put the children at risk of ridicule, humiliation,
  and possible physical assault; and her comments were inappropriate and
  lacking in judgement".  This is in a report to the court, and is part
  of their basis for wanting to keep my daughter in a foster home for 
  another 6 months.  The reason they took my daughter was a false report
  stating that two of our sons had sexual intercourse with our daughter,
  but medical reports even prove that no such thing ever happened. Anyway,
  we are interested in information on civil suits against social services
  and whoever else we can include.

I'm back, and I hope your client has good luck with his appeal.  I know
of a few people this has happened to, and to be wrongly convicted is
really tragic.
I haven't seen you on here for awhile, so just in case you missed it, I'll
let you know that there is also a VOCAL (Victims of Child Abuse Laws) echo
on FidoNet now.  George Wimberly (founder and president of VOCAL/NASVO)
gave me permission to start it.  Your input on the VOCAL echo would be a
welcome addition.  Traffic on the echo is sporadic, but will pick up as
time goes on.  It is also going to be announced at the VOCAL conference
in September and hopefully that will put us in touch with more of the 
experts in the field.
