If you read again we are talking about a CIVIL trial.
In a criminal trial it has to be proven that I did it.
In a civil trial all that is needed is for the other
lawyer to make the family look so bad off that the jury
feels sorry for them.
There is case after case after case where a company has
been sued and lost in cases where anyone with common
sense would say "you got to be kidding!" Most of which
were tossed once the case was reviewed by an appellate
judge.
Winning a civil case has very little, if any, bearing
guilt.
