Replying to a message of Ross Cassell to Bj”rn Felten: RC> Hello Bj”rn! RC> 23 May 06 18:16, you wrote to Joe Delahaye: JD>>> In the US if it gets to court, it WILL cost him a lot of money, JD>>> win or lose. I dont know how it works in Europe, BF>> I'd say that in most of Europe you will never have to suffer any BF>> damage whatsoever if you're dragged into court by someone, and this BF>> someone loses. I'm sorry to hear that this is not the case in the US BF>> (if that is true). RC> It depends on the civil law of the state, in some cases if someone RC> gets sued and prevails, the person who who did the suing, is or can RC> be ordered to pay the court costs. That's only the costs incurred by the court. The costs - lawyer's fees, witness' fees if applicable, etc. - of the winning side are still paid by the winning side. Everyplace else on the planet, if you sue and lose you get to pay the costs incurred by the winning side in addition to your own. I suppose the winning side could turn around and sue the losing side for reimbursement, but that's a separate action - and even if you win a judgment, collecting it is another whole matter. --- FleetStreet 1.19+* Origin: Bob's Boneyard, Emerson, Iowa (1:2905/3) SEEN-BY: 633/267 270 5030/786 @PATH: 2905/3 14/5 153/757 106/1 2000 633/267 |
