Subject: Legality of Commandeering cars
BB>But, for my two cents, it is legal in a number of states for
>the FIRE department to commandeer people or equipment, (ie cars,
>trucks, etc) in the event of a forest fire. Not sure if it would
>hold up in court now a days, but it is on the books.
Maryland statute law discourages if not bans it. Maryland Supreme
Court case law recognizes and allows police to commandeer vehicles
in an emergency.
In a court of law, even where a person or officer has committed an act
that violates criminal law, "Emergency" is a viable defense.
