In the US courts, the winner of a civil suite collects attorney fees from the loser. The loser also pays court costs. It's much cheaper to litigate a settlment out of court, if you can. The payee still gets to pay for the plaintiff's attorney, but it won't be nearly as much if there's no trial involved.
