Forget it.
Few courts will hold anything to that effect. "Informed consent" to
_what_ would be one obvious question...if a surgeon saw an unrelated problem
while inside the patient, did he have "informed consent" to try to correct
that according to this idea?

Also note that you say everything went O.K. The case was of
