Hi Bill. Have not seen you post in some time and hope that everything
is going well. I wrote you while I was in California, but don't know if
you received it or not. Suspect you did not because I never got a
response.
I was sorry time would not allow us to make the trip to Washington and
meet you and your wife. I was out there during April and the first of
May, but found out we had to get an extension on our appeal brief so I
had to get back a lot faster than I wanted to.
I met some of the nicest people I have ever met in California and, thank
heavens, gathered enough information to do what should have been
impossible. When I got back, we tried to get an extension on the
appeal. My guy's attorney filed his 5 page appeal without permission
from anyone so we had 30 days to file an addendum or supplement. Every
attorney the family talked to said, not enough time, or nothing they
could do, so as it ended up, I wrote the supplement and my client filed
it Pro Se from prison. I think our supplement was 80 pages, but we
really adressed the psychologist's testimony and hopefully will get it
thrown out for two reasons; her testimony was for the sole purpose of
discrediting his daughter's testimony and there is no scientific basis
for rendering an expert opinion that sexual abuse did or did not happen
short of medical findings. I found laws in Mississippi dealing
specifically with that and quoted them as well as a number of national
laws and research.
This week we are filing complaints against the psychologist with the
Mississippi and American Psychological Associations; my client's
attorney andd the prosecutor witht the bar association and complaints
against social services and an organization called CASA.
Next week, hopefully, we will outline civil actions against social
services, CASA, my client's attorney and the psychologist.
He has been in prison a year now, but maybe we are on at least part of
the downhill side.
Oh yea, there were two major cases in California brought by Milton
Silverman; cases I was really interested in because he broke the
immunity of the DA and was successful in bringing actions against the DA
and therapists. I called him, delivered the information he requested to
his office and then sat in a motel and waited 5 days to hear something.
Never heard a word. Also, when I first started this project, I left
numerous messages pleading for help on Bob Hirschfield's BBS and never
heard a word there either, so the people I thought would be the biggest
help never even so much as responded, but as I said, I met some
fantastic people and without their help, I never would have undertaken
writing the supplement to the appeal my client's attorney filed.
Oh yea, one fine light note. The 5 page brief filed by my client's
attorney; he got the case number wrong and even got the information he
quoted regarding what my client was convicted of incorrect. The only
thing he used was 4 Mississippi cases supporting why "hearsay" should
not be used. Never found or quoted any of the laws we did.
Time will tell. I still think about you and your wife often. I hope
everything is well. Drop me a note if you get this.
Allen
