It's silly to think they _couldn't_ sue them.  That would directly harm Atari
with false advertising.  That's no better (and maybe even worse) than
Nintendo running ads that make the Game Boy look like it's a color system,
when at the time the Lynx was the only color handheld.  Atari sued them and
won.
