-> Even more unusual, clandestine taping is part of the wiretap
-> statute.
DA> I still think you are mixing up the taping of open-air discussions
DA> with taping of conversations carried by wire.
Nope, not mixing them up at all. Just reporting what Oregon has
in their statute.
Taping someone in your physical presence without their permission
is illegal in Oregon, with some exception: examples are; police officer
in performance of their duty; meetings of _public_ bodies such as city
council, news conferences, etc. And as I said before, It _is_ part
of the wire tap statute. The statute also included a prohibition
regarding cordless phones (now made academic by recent Federal regulations).
Notice that besides interception of wire communications they also put
in radio transmissions and in person face-to-face recordings.
This face-to-face recording is for _clandistine_ recordings. If
you have up a sign saying that the premises is being monitored by
electronic means then you probably would be safe. Bear in mind I am
not a lawyer, and your mileage may very.
... I wish the buck stopped here! I could use a few!
