In case you weren't aware of it Rich, the burden is always on the
state. YOU don't have to prove anything. Finding out what a substance
is constitutes an important element in preparing any criminal
prosecution and establishing probable cause.

On that point I would agree with you; but you have to keep in mind that
discretion under those circumstances is part of a judge's job. That
is not the function of a law enforcement officer; and some officers who
are in the habit of giving "breaks" sometimes have them fly back in
their face.

In this situation, I would not have a problem. If I believe her
story.......and it's reasonable to assume that it's true.......
she really is only technically in violation of the law and probably
innocent by reason of no criminal intent (depending on the wording
of the statute.
