It depends.  If there is a contractual relationship that requires that the
taxpayers cough up the money then yes it is.  If there is a legal
requirement that the taxpayers cough up the money then yes it is.
If the individual is receiving taxpayers' money that s/he is not entitled
to under the law, then no it isn't - and the individual is probably in danger
of felony prosecution.
