The purpose of immigration laws, per the Supreme Court of the United
States, is to protect national security, and to protect American jobs
for Americans and legal permanent residents.

Immigration policy should be formulated due to economic factors,
demographic factors that impact on a society's ability to assimilate new
members, and other factors that serve the collective good of the nation.
NOT based upon "diversity" or other fuzzy feel good reasons.

There is a distinct difference between POLITICAL asylum and ECONOMIC
asylum. We have no laws that allow a person to legitimately file for
asylum based upon economic factors. We DO have laws relating to
Political Asylum.
Let me illustrate. There is a legal requirement that one who is facing
an attack has a LEGAL obligation to retreat as far and as quickly as he
or she can to avoid the attack. They do not have carte blanche to meet
violence with violence until such time as they cannot retreat any
further. This is the "retreat to the wall" principle. There is NO
requirement to retreat in one's own home or place of business.
Once they retreat and the attack ceases, they cannot return and "defend"
themselves by attacking the original attacker.
A similarity exists when one is fleeing political strife. Once they are
safe, then the danger that existed no longer poses a threat. If that
means a person fleeing Guatemala crosses into Mexico and there is no
political strife there that meets the legal criteria of a "well founded
fear of persecution based upon one's race, religion, political
affiliation, etc." on one's person, then to continue further to another
country visciates their claim for asylum since they are no longer
fleeing for their physical safety.
They ARE fleeing economic poverty. Granted, it's unfortunate, however it
doesn't meet the legal test for POLITICAL asylum.
Furthermore, we've had cases involving a claim for asylum by Vietnamese
who had firmly resettled in France, became FRENCH citizens, and then
abused the asylum process here for the sole purpose of reuniting with
other extended family members here in the United States.
It's a fraudulent claim for asylum. It's an abuse of the system. BTW,
asylum grants are NOT counted against the numerical limitations set by
Congress for immigrant visas. Furthermore, they can obtain employment
authorization after their case goes beyond 180 days from the date they
file for asylum. This includes all appeals filed by them regardless of
how long these appeals may take.
