Unfortunately It's all legal. The ASC made them include information
saying that investors may be able to sell their shares for more
elsewhere.  What gripes me is that a number of my companies have
had to mail out letters to their investors, warning them of the
scam. 
 
More postage and paper wasted unnecessarily!
