I missed the first part of this, but I seriously doubt that reporters are 
exempt.  I cover NASCAR races for Racing Information Systems and we're told 
specifically that we're prohibited from using any information we hear on a 
scanner, unless we have prior permission from the teams or NASCAR.  And the 
reasearch I've done myself backs this up.  The FCC's own web site has a 
section on about how it's illegal to act on or tell someone else what you've 
heard on a scanner...
