There is no legal requirement for transmitting gear to be sold only to licensed amateurs, and even if an unlicensed buyer tried to use it, nobody's going to talk to him anyway, not without a legal callsign. Lots of people buy transceivers to use for receiving only these days, as they are quite often much cheaper than purpose-built communications receivers.
