Nope, if you are actually operating an illegal pyramid marketing
scheme, it doesnt matter how successful it is, what matters is
if you are operating an illegal pyramid marketing scheme or not
as far as the illegality is concerned.

Sure, in some circumstances the resources may not be devoted
to getting proof and charging you etc, but thats a completely
separate question to whether its illegal or not.

Its illegal to exceed the speed limit, sometimes they pursue
that, sometimes they dont. Doesnt change whats illegal tho.

its clearly illegal to attach non Austel approved phone devices
to the PSTN. They dont put too much effort into pursuing that,
they appear to have decided to just make it illegal, put the
frighteners on people with the massive potential fine, and
dont consider its worth devoting more resources than that to it.
