Neither.
They are guilty when they commit a crime.  They are innocent until they
commit a crime.
In this country (USA), they are _presumed_ innocent until they are
_proven_ guilty in a court of law.   Its a matter of constitutional
guarantee against unlawful prosecution.  The individual was just as
guilty before he was proven so as he was afterward.
This has little to do with proof of existence on non-existence.  And,
nothing to do with whether or not UFOs (or the tooth fairy) exist.
Now, if you will, answer the question... Does the absence of evidence
proving that the tooth fairy doesn't exist prove that he does?
