they designed and put the parts together to create the physical modem, yes... 
but the OEM "tag" or "label" says that some other company that puts the 
computers together and puts the modem in the computer as part of "the whole 
package" is the manufacturer you have to talk to.
in other words, someone made the part and someone else put that part in a 
package. it is the ones that made the package that are responsible for the 
part.
