Why is it a state matter, Bill? Have you ever been involved in a case where
the INS places someone in this status?
And you haven't read the 11th *Circuit* (not District) ruling. If you had,
you would know that the Court specifically did not deal with the custody
issue. It's in Footnote Number 16 -- "We need not decide where or in
whose custody Plaintiff should remain while this appeal is pending."
