Yes, the law proscribes some particular activitys. Those activitys are illegal regardless of whether anyone actually chooses to break that law or not. BUT when deciding if a particular activity of a particular person is illegal activity or not, particularly when considering whether to say charge them or not, or say tell them to stop doing that or they will get charged, its their actual action, whether they have actually broken the particular law which counts. Not that they could if they wanted to. Maybe you should think about the road rules for a simple example that even you might be able to grasp. The law proscribes a particular speed being exceeded in a particular situation.
