The FCC has no rights, they have self assumed "privilege", they gave
themselves that alleged power. Government has privelige or certain
powers granted, and supposedly any powers are specificically delineated
and "limited" to those powers allowed it by the main body of the
Constitution.
Only individuals have rights, and these are not granted to them by
government, they are natural to all individuals by virtue of being born
a human being.
There is little difference in the monitoring of radio transmissions by
the FCC and the NSA, than the illegal activities of the various other
alphabet soup government policing agencies who use their assumed powers
to track guns, and their owners.

"Simply listening in on the spectrum", is "MONITORING", that is the
governments self assumed duty.
NSA monitoring WHAT!?? What kind of equipment are they maintaining other
than illegal privacy intruding equipment?
These bureaucrats/spooks use the monitoring of the spectrum allegedly
to maintain it's integity and quality as a simple cover for monitoring
"CONTENT".
The technology for mass use of a single frequency permitting many
thousands of simultaneous users without any interference to each other
is over twenty year old. It is not unlike the technology used to
multiplex information over a single telephone wire while maintaing the
integrety of individual transmisions.
This technology is not welcomed by the spook agencies or the FCC because
it involves encryption coupled with what is today common compression
techniques, making the monitoring of "content" extremely difficult at
best, and impossible in most ordinary circumstances.
Reference, the JTIDS system used by the military, which allows the
simultaneous use of a single radio frequency, (of which there are tens
of thousands), by over 90,000 users without any knowledge by the user
that there are other users on the same channel. The system allows any
number of people to engage in communications by the use of an agreed
upon key. The comunications remain private between them, and not
available to anybody else on the frequency, and is accomplished without
interference with any of the other users. These systems are virtually
immune to normal jaming, and cross channel interference.
The real reason for the FCC, and the various alphabet soup "spook"
agencies want to monitor the spectrum, has nothing to do with spectrum
integrety, it has only to do with:
"CONTENT OF THE COMMUNICATIONS"
Anybody who wants their comunication to be private from snooping
neighbors, marauding phone phreaks, and the wife's private detective
she hired to catch you, can get equipment with a chip that utilizes the
DES encryption standard (government/NSA approved), meaning it will
prevent any body, (but the government), from listening in. The chips are
cheap, they're $0.94 each in 1,000 quantity from the manufacturer. But
beware, as the chip has been approved for by the NSA for open
uncontrolled distribution , it means they have an instant back door to
decode it without the necessity of getting your secret key. Be as it
may, if you trust the government, (and who doesn't ? :-) ), the chip
holds 8, 64 bit DES keys. At least the 13 year old with a scanner won't
be able to listen in.
