You are misunderstanding the law.
There are both law enforcement and professionsal groups who are allowed, by
law, to purchase unblocked scanners. And they do.

That's a moot point, and doesn't really mean anything in context.
The reality is, there are both law enforcement and professional groups who
are defined by law as being able to purchase unblocked scanners. ICOM is one
of several manufacturers who make and sell such scanners.

The Government is *not* above the law; certain segments of it are

You might have a hard time trying to convince several law enforcement
agencies of that. I seriously doubt that you are such an insider that you
can say with any certainty that you understand the requirements of such
agencies.
