That actually sounds like the whole thing is a donation to a charitable cause,
the legally taken game (donated), the processing (services/materials donated),
and finally your actual $"donation". Which would make it non-commercial from
start to finish. However, I'd expect that if Joe Blotnik went out and whacked
Bambi/Rudolf/Bullwinkle, then put him up for sale at $X.99/lb it might be
viewed a little differently.
Took a quick look and the Lacey Act seems like it "prohibits trade in wildlife,
fish, and plants that have been illegally taken, possessed, transported, or
sold."
Didn't spot anything, quickly, in Goggle about legally taken for commercial
usage, although I suspect that each State will strictly regulate, i.e.
commercial license, or just flat ban it. Assuming the Federal side,
House/Senate, hasn't already stuck their nose into it.
Since this all seems to relate to whales, sometime in the distant past I'm
guessing. I'll add that Jim Capaldi did an album named "Whale Meat Again", has
some pretty good songs on it. Especially his song "Low Rider", as compared to
the song by War which I also have.

Title: Bambi Meets Popeye

Yield: 1 Servings
1 lb Bambi burger
10 oz Pkg frozen chopped spinach
5 Or 6 eggs
2 tb Cooking oil
2 md Onions
2 tb Cooking oil
Salt and pepper
Ground parmesan or romano
Cheese
Chop the onions. Brown the venison (in a little oil, if needed)
along with the chopped onions.
When the venison and onions are done, mix in the thawed chopped
spinach and cook until the spinach is hot. Salt and pepper to taste.
Beat the eggs and stir them into the venison/onion/spinach mixture.
Stir and turn until the egg is cooked. Remove from heat and top the
skillet with a generous layer of ground parmesan or romano cheese.
