On appeal, if she has/had already publically pre-disposed herself to Side B
and rules for side A, Side A has a legitimate complaint to lodge. She must
at least paint a public face of impartiality.

If you were going on trial for a crime, before the evidence is heard, you
wouldnt want the judge or the jury taking a position on the case, yes?

You and I and many other people can armchair quarterback this thing to our
hearts content, but the coordinators in the appeal chain are somewhat
hobbled.
