I don't see why it wouldn't apply either. If the 4th guranantees against
illegal *search*, it should cover instances such as this.
I suspect that the administration knew they were on shakey ground, hence
the pressure to act quickly... despite the unnecessary danger it created
for all involved.
I'm still curious as to what is motivating Clinton to act in this seemingly
irrational way (Dick Morris thinks he has lost his political mind). He is
purely a self-interested political animal who NEVER thinks about his impact
upon others (or the country) in terms that do not effect him personally.
So, could it be:
1. Some sort of deal with Castro (perhaps normalization) that Elian is
interferring with.
2. Or, threats from Castro, such as:
- Another boat lift.
- Perhaps he expressed "curiosity" about what may have happened to
Clinton's hero (JFK)
- Castro's deep involvment in international criminal activities means
he could he could have threatened to reveal information on Clinton's
potential criminal associations.
- Maybe he knows what Clinton was doing in Russia in the dead of winter
during his Oxford days.
