Replying to a message of Phil Payne to Tony Ingenoso: PP> From: Phil Payne >> As I said, our detention seems pretty lightweight by comparason no? Do >> you PP> think we'll have those folks in Guantanamo 25 years from >> now? I suspect not. PP> I wonder what sort of compensation claims you will face from those you PP> cannot pin any charges on? Evidence can be manufactured, and the FBI has arguably the best practitioners - followed closely by BATF. I'm sure they've improved since they stepped on their collective d*cks and got caught lying on the stand at Randy Weaver's trial ten or so years ago. Despite all the 'evidence' presented at that trial, the jury acquitted Weaver of the original charge (he was convicted of 'failure to appear', which came later, and was sentenced to time served); after a couple of weeks of prosecution, Gerry Spence's total defense was the statement "The government has not proved its case." The jury agreed. Note also that the surviving Davidians were *also* acquitted of murder charges at their trial. The jury felt they had to convict them of *something* though, so they convicted them on 'use of a weapon to commit a felony' - the problem being that the defendants were acquitted by the same jury of having committed the felony. Didn't matter to 'Judge' Smith, though, the defendants got forty years in the federal slammer (with no prior records). ---* Origin: Bob's Soapbox, Plattsmouth, Nebraska, USA (1:379/103.104) SEEN-BY: 633/267 270 @PATH: 379/103 1 633/267 |
