They're in the custody of the US government, on a US military installation
(which in most any other situations is considered to be US soil).  That's
two reasons why the Constitution should apply.
And one reason why the Geneva Convention on prisoners should apply.

There is also at least one fellow in this country who's being held without
charges and without access to counsel on John Ashcroft's sayso.  The
Constitutional requirements that one be able to face one's accusers and be
accorded a speedy jury trial don't apply, because John Ashcroft says so.
