Yes it has.  When John Ashcroft says one is a terrorist or an 'enemy
combatant' one can be incarcerated forever, without a trial, without access
to counsel, and without access to the Red Cross (a requirement of the
Geneva Convention for combatants).  All because John Ashcroft says so.
