Same here. Rom 1.06 gives 28k8 connects, but cps rate will never reach 
anything better than 2400 or 2500...
Sometimes it just drops and drops and drops and drops...

ZFAX 4.01 works okay with voice overhere. But I guess after two years of 
using ZFAX with my U1496E+ I'm used to getting it to work.
Still one problem; the Elite hangs after data-shelling to RA.
RA works fine, but shelling back to ZFAX makes to modem go "DOES NOT RESPOND"
Same setup worked 100% with ZFAX 3.12 and the U1496E+ with rom 6.11a
Have you tried disconnecting anything else from your phoneline? Try with only
the Elite connected en see if it works.
Plugging your phone into the PHONE-IN on the Elite works overhere with 
recording messages via your phone handset.
