The US military base in Guantanamo belongs to Cuba, not the US. We rent the place, paying rent money every year. That may mean nothing to you, but in US law, if the territory in question is not US territory, then US law simply does not apply. The Brits, and perhaps your country in colonial times, did it differently. The Brits, for example, apparently exercise sovereignty over its bases in Cyprus. The US has never done that kind of thing. For example, when we gave independence to the Philippines and retained some military bases there, we rented them.
