The Italians were not told that the US base was US territory and therefore US law applied. No such claim was ever made. Because it was US military personnel involved, they were subject to the UMCJ. However (and it is a big however), when and under what conditions that jurisdiction applies is subject to treaty arrangements between the US and the host country. Those arrangements differ from country to country. I don't know what the case is with Italy. Do you?
