Like I said, you get charged the exact same cancellation fee if you do
not get a free phone. And you still have to sign the same term of
contract if you don't get the phone. The only difference between someone
who gets a free phone with activation and someone who does not is that
for the former, the carrier makes a lower profit margin.

Even when there's a warranty, it is still the owner's responsibility to
take the phone to a warranty repair center to have it fixed. Little
elves don't come and get it for him. And if a piece of expensive
property is stolen, the owner (if he has any sense) has it insured for
its replacement cost.

Maybe in Canada you get free dialtone, but here in the states, it costs
a certain amount of money just to have a landline phone line into your
house with dialtone on it. If you make no calls at all, you still have
to pay a minimum amount.
