I have a question regarding "Window Tint" on the O.R.C. chapter
4513.241 as it relates to its reference to the O.A.C. section 4501-41,
specifically 4501-41-03 (a)(3) in that section, I was recently stopped
(5-3-96) by the Highway Patrol for this and went to court in akron on
(5-21-96), I should mention also I work for an Investigation Agency
which the trooper was made aware of at the time of the stop, he also
took a lock-out tool from my vehicle ("slim-jim") stating it was a
criminal tool, it has since been replaced by the Commander at the
Highway Patrol Post which he is from.
I need to know what *your* interpretation of the OAC is as mine says it
is vague as exactly which window they mean specifically, I take it as
being the front window(s) to both the Immediate left and right side of
the driver and the rear most window on the vehicle (regardless of the
type), Except for Limos and Buses.
The trooper stated there was a supreme court ruling stating that all
windows are to conform to the 50% rule, not just the ones I've
mentioned. Also, he stated that he "couldn't see into the vehicle on
approach to it", this is b*ll as he stated when he stopped me, he could
see into it.
"Being a duly sworn officer, and I myself an officer of the court as an
Ohio Notary, I can not see him intentionally, knowingly and willfully
lying to the court for his own benefit."
Now, he also didn't measure the windows with a proper measuring devise,
he just looked at it and said they're to dark, but in court he used film
cards, which were not identified as to which was what percentage.
If thats the case, can you direct me to the ruling by the supreme court
on this so I may read it and get a copy for myself.
I would sincerely appreciate any assistance you can give me.
