This is true.
However, it seems that this is being interpreted to mean that you can not
use any info that you overhear to harm anybody, or to profit from that
information.
There are many pager networks accross the country that page information to
members about things heard over public service frequencies. Technically,
this is illegal. However, since no one is being harmed, and no one is
profiting from the net (any money made is made from the service, not from
the actual info being shared), so nobody complains (at least, no one
prosecutes ;-) ).
In the Glass case, the prosecution attempted to bring up that very point,
but the judge ignored it.
